VENTISCLUB TERMS AND CONDITIONS



Definitions

Terms and expressions with a capital letter, without distinction between singular and plural, have the meaning indicated below unless otherwise specified:

  • Cashback: indicates the discount for purchases on VENTIS that the Customer is entitled to use. to benefit under the conditions and terms set out in the General Conditions;
  • Customer: indicates the person who makes purchases through VENTIS;
  • General Conditions: indicates these General Conditions and any updates/modifications that may arise for the regulation of the Loyalty Program;
  • Start Date: indicates the date of May 23, 2022;
  • Wallet: indicates the “virtual wallet” accessible by the Customer through their personal area within the “Ventis Credit & Coupon” on VENTIS from which the entity of the accumulated Cashback;
  • VentisCLUB and/or Loyalty Program: indicates the loyalty program managed by VENTIS srl and governed by the General Conditions;
  • Cashback deadline: indicates the final deadline (date) by which the Customer will have faculty to use the accumulated Cashback;
  • Site: indicates the website identified by the URL en.ventis.com;
  • Annual Expenditure: indicates the total expenditure made from 23 May 2024 to 22 May 2025 by the Customer on VENTIS;
  • VENTIS: indicates the online sales platform accessible from the Site or App.;
  • VENTIS srl: indicates the Company VENTIS srl with registered office in via Urbinati, 7, Bellaria Igea Marina, RN c.f. and registration number in the Company Register: 06853120969.
  1. VentisCLUB

VentisCLUB is the loyalty program that allows Customers to obtain up to 4% Cashback and other benefits based on the volume of purchases made on VENTIS.

VentisCLUB is governed by these General Conditions.

VENTIS Srl is the creator and promoter of the activities available on VENTIS and the VentisCLUB service.

The General Conditions integrate the legal terms and the Cookie policy published on the VENTIS.IT website

  1. How to join VentisCLUB 

Starting from the Launch Date, and therefore with regard to each purchase made on VENTIS from the Launch Date, all Customers have access to the VentisCLUB in accordance with the to the General Conditions.

The Cashback, and any additional benefits provided by the Loyalty Program, will be usable by the Customer from 23 May 2024 following assignment of a program level. The Cashback and the details relating to it will be consultable by the Customer by accessing their personal area by logging in to VENTIS, via the web or via the corresponding mobile application.

In the personal area of each Customer there will be a special section dedicated to VentisCLUB is visible.

  1. How the Cashback is determined 

Based on the Annual Spending realized from 23 May 2023 to 22 May 2024, Customers will be divided into four levels: BASIC, GOLD, PLATINUM and DIAMOND.

From May 23, 2023, the Customer will have access to a Cashback determined based on the respective membership level.

Basic Customer will be the Customer who, from 23 May 2023 to 22 May 2024, will have achieved a total annual expense of less than 300€. For this level of customers it is not Cashback expected.

Gold Customer will be the Customer who, from 23 May 2023 to 22 May 2024, will have achieved a total annual expense of between 300€ and 599.99€. The Gold Customer will have right to Cashback of the 1%.

Platinum Customer will be the Customer who, from 23 May 2023 to 22 May 2024, will have achieved a total annual expense of between 600€ and 1499.99€. The Platinum Customer will have entitled to 2% Cashback.

Diamond Customer will be the Customer who, from 23 May 2023 to 22 May 2024, will have achieved a total annual expenditure greater than 1500€. The Diamond Customer will have entitled to 4% Cashback.

If the Customer moves from a lower level to a higher one or vice versa, he will acquire always the level corresponding to the Annual Expenditure achieved during the previous year. For example: a Basic Customer who, from 23 May 2023 to 22 May 2024, spends 700.00 euros, will acquire directly, for the following year, the status of Platinum Customer; a Diamond Customer who, from May 23, 2023 to May 22, 2024, spends 200 euros, will acquire directly for the following year, the status of Basic Customer.

Changing or confirming the membership level will be made upon request. communicated to the Customer and will be visible within your personal area.

The annual expense will be calculated from 23 May 2024 to 22 May 2025 on the total items purchased net of shipments, returns, discounts on the order, coupons, Wallet funds (unless coming from direct top-up) and transactions using CARD BCC/Twenty Card. Orders that are canceled are not included in the calculation of the Annual Expenditure.
Every year, for each user, there will be a It is possible to accumulate a maximum of 300 euros of Cashback.

  1. Credit and use of Cashback

Having defined the membership level based on the Annual Expenditure realized from 23 May 2023 to 22 May 2024, the Customer – for each purchase made on Ventis during the following year (23 May 2024, 22 May 2025) – will benefit of the Cashback in the percentage due. The Cashback will come recognized to the Customer upon completion of each order in the form of crediting the corresponding amount to the personal Wallet and will be usable exclusively in the form of credit for purchases made on VENTIS in the three months following the credit.

The Cashback will be calculated on the basis of the total price of the items in the order net of shipping, discounts and use of Wallet funds.

In the section of the personal area dedicated to VentisCLUB the Customer will be able to always check (a) your current membership level; (b) the Wallet with the accumulated Cashback; (c) your annual expenditure; d) the cost that is missing to reach the next level.

The Cashback deadline will be visible in the Wallet, by accessing your personal area within the “Ventis Credit & Coupon."

The Cashback obtained can be can only be used with your personal account and cannot be used in any way be transferred to other accounts.

If an order that has generated a Cashback generates a refund for the user (cancellation by Ventis or return), the Cashback will be canceled for the refunded amount.

  1. Modification of the General Conditions – suspension and/or interruption of the Loyalty Program

VentisCLUB is a benefit provided to VENTIS customers. Consequently, VENTIS srl reserves, at any time, the right to modify the General Conditions and will inform the Customer of the changes introduced with the methods which he will consider more appropriate (for example: through publication on the Site and/or through individual communications, via email, text message, etc.). The version of the General Conditions applicable from time to time to the Loyalty Program will be the one available on the Site.  All modified versions of the General Program Conditions will be applicable starting from their publication on the Site.

VENTIS srl will be able to suspend or terminate, temporarily or permanently, the Loyalty Program, for any reason at its sole discretion. Suspension or termination of the Loyalty Program will enter in force from the date of publication on the Site.

The Customer will be informed of any suspension and/or discontinuation of the Loyalty Program by sending an e-mail informing him/her and will invite him to connect to the Site.

The suspension or termination of the Loyalty Program he will not give right to any type of compensation in favor of the Customer, but the Customer will be entitled to the use of the Cashback is already permitted credited to the Wallet by the relevant deadline.

If the Customer cancels their account on VENTIS, the Cashback accrued and not yet used, as well as as well as any additional benefits recognized and not yet used, will be considered waived and will be lost automatically and immediately.

In the event of termination of VentisCLUB by the company, VENTIS Srl assumes no responsibility. for the Cashback not used by participants or for the loss of other benefits related to the program.

  1. Processing of personal data

The Customer's personal data collected in relation to participation in the VentisCLUB Program will be processed by VENTIS srl for the following purposes:

  1. for the management of the Loyalty Program VentisCLUB as well as for the attribution of advantages strictly connected to the aforementioned program;
  2. for direct marketing initiatives (for example: sending advertising material, communications of promotions on products similar to those purchased);
  3. for carrying out market surveys and analyzing purchasing and consumption habits (creation of customer profiles) also through communications sent via e-mail.

The processing of data for the purposes referred to in the previous point 1. is necessary for the purposes of participation in the Loyalty Program, pursuant to art. 6 first paragraph letter. b) GDPR. However, it is necessary to acquire the specific consent of the Customer, pursuant to art. 6 lett. a) GDPR, for the purposes referred to in the previous points 2. and 3. Consent for such treatments is optional with the consequence that the Customer will be able to decide not to provide consent, still adhering to the Loyalty Program. However, to receive information related to the Loyalty Program, updates and personalized proposals, the Customer must authorize VENTIS to process your data for purposes of marketing.

The data will be processed using IT and paper tools and protected at every stage of processing through the adoption of suitable security measures.

The personal data provided may be made accessible, pursuant to Article 13 of the GDPR:

- to the employees, collaborators and consultants of VENTIS srl;

- commercial partners and service providers;

- to other companies belonging to the VENTIS group also having offices in other countries of the European Union;

- subjects or societies responsible for the management and maintenance of the VENTIS IT and web platform and external suppliers through which the sending of advertising and promotional material services are provided for which it is consent has been given;

- to individuals, bodies or authorities; to whom the communication of personal data is mandatory pursuant to legal provisions or orders of the authorities.

The data will be stored (in electronic or paper archives) for the entire duration of membership/participation in the Loyalty Programme. and for sole purposes administrative (without prejudice to specific legal obligations on the conservation of accounting documentation pursuant to art. 2220 of the Civil Code) for the following 12 months, or until the possible revocation of the Customer's consent.

The Customer will be able to exercise the rights referred to in art. at any time. 7 of the Privacy Code and art. 15 and following. of Regulation (EU) 2016/679 (including, by way of example, obtaining confirmation of the existence of data concerning the Customer and their communication in an intelligible form, the indication of the origin of the data, the purposes and processing methods, updating, rectification or integration of data, cancellation), by writing to VENTIS srl with registered office in Rimini, Via Marecchiese n. 275/C or by opening a ticket in the “Write to us” within your personal profile.

At any time the Customer can contact object to the processing of your data, including your e-mail address, for the sending of advertising material, direct sales, carrying out market research or commercial communications by the Joint Controllers, or in the manner above.

  1. Applicable law and competent court

Any dispute relating to the execution or interpretation of the General Program Conditions is governed by Italian law and for any dispute relating to the interpretation and/or execution and/or termination of the General Program Conditions, it will be the Court of Milan is exclusively competent, without prejudice to any different jurisdiction established by mandatory mandatory rules.
